Musical Getaways LLC, doing business under the trade name MusicExperiences.com

These Terms & Conditions (the “Terms”) are a legally binding agreement governing access to and use of MusicExperiences.com, related websites, booking tools, communications, and services (collectively, the “Platform”). Please read them carefully before creating an account, publishing a listing, booking, paying, hosting, or participating.
1. Parties and acceptance
“MusicExperiences.com,” “Music Experiences,” “Musical Getaways,” “we,” “us,” and “our” mean Musical Getaways LLC, a Colorado limited liability company operating MusicExperiences.com as a trade name. “User” means any person accessing the Platform. “Guest” means a purchaser or participant. “Host” means the independent person or business offering an experience.
By using the Platform, checking an acceptance box, making or receiving a booking, or signing electronically, you affirm that you have read, understood, and agree to these Terms and the policies incorporated into them. If you book for another participant, you represent that you are authorized to provide booking information and required notices, but you may not sign an adult participant’s separate waiver for that person.
2. Marketplace role and independent Hosts
Music Experiences provides a marketplace that helps Guests discover and book music, cultural, educational, entertainment, and related experiences offered by independent Hosts. Unless a listing expressly states that Musical Getaways LLC is the direct operator, the Host—not Musical Getaways LLC—controls and provides the experience.
Hosts are independent contractors and are not employees, agents, joint venturers, partners, or representatives of Musical Getaways LLC. Publication, review, verification, or promotion of a listing does not make the Host our employee and is not a guarantee or certification of safety, legality, quality, accuracy, suitability, or results. We do not control every act or omission of a Host, venue, supplier, transportation provider, or participant.
3. Eligibility, minors, and accounts
- You must be at least 18 and able to enter a binding contract to create an account, make a booking, or act as a Host.
- A minor may participate only when the listing permits it and a parent or legal guardian gives the required consent and completes any required guardian waiver.
- You must provide accurate, current information and protect your credentials. You are responsible for activity conducted through your account unless promptly reported as unauthorized.
- You may not impersonate another person, create deceptive accounts, misstate participant counts or ages, or use the Platform after suspension without written permission.
4. Listings, availability, and booking formation
Listing descriptions, schedules, meeting points, accessibility information, inclusions, exclusions, age requirements, physical demands, and safety disclosures are supplied by the Host and may contain reasonable conditions specific to the experience. Guests must review the complete listing before booking and ask questions before payment when a fact is material to participation.
A booking becomes binding when the Platform confirms successful payment or, for a request-to-book experience, when the Host accepts and the Platform confirms the booking. A pending cart, payment attempt, message, or availability display does not by itself create a confirmed booking. Obvious pricing, availability, or technical errors may be corrected; if an error materially changes a confirmed booking, the affected Guest may accept the correction or receive a refund of the eligible amount paid through the Platform.
5. Prices, payments, fees, payouts, and taxes
Guests must pay the total displayed at checkout in the stated currency. Payments are processed by third-party payment providers under their terms. Music Experiences is not a bank, trust company, or escrow service. Payment authorization may be declined, delayed, reversed, or reviewed for fraud or compliance reasons.
The Guest-facing price may include a platform margin or fee. Music Experiences may deduct platform compensation, refunds, chargebacks, reserves, transfer costs, taxes, penalties, or other authorized adjustments from Host payouts. Payout timing is conditional on successful collection, completion status, fraud review, refund and chargeback exposure, verification, provider rules, and applicable law. Hosts remain responsible for their own income, sales, lodging, entertainment, value-added, and other taxes unless the Platform is legally required to collect or remit them.
6. Cancellations, refunds, changes, and no-shows
The Cancellation & Refund Policy is incorporated into these Terms. Unless a listing lawfully provides a more Guest-favorable policy:
- 168 hours or more before the scheduled local start time: 100% of the eligible booking amount is refundable.
- At least 48 hours but less than 168 hours before the scheduled local start time: 50% of the eligible booking amount is refundable.
- Less than 48 hours before the scheduled local start time: the booking is non-refundable.
The time a cancellation request is received through the Platform or by info@musicexperiences.com controls. Failure to arrive, late arrival that prevents participation, failure to satisfy a disclosed age or participation requirement, removal for unsafe or seriously disruptive conduct, or a voluntary early departure is treated as a Guest cancellation within 48 hours unless applicable law requires otherwise.
If the Host cancels or fails to appear, the Guest is eligible for a full refund of the booking amount paid through the Platform. Reasonable Host changes that do not materially reduce the experience may be permitted. If a material change cannot be reasonably cured, we may arrange an alternative, issue an appropriate partial refund, or cancel and refund the eligible amount.
Documented extraordinary circumstances may be reviewed individually. A review is discretionary and does not guarantee a refund. Processing, currency-conversion, transfer, and nonrecoverable third-party charges may be excluded from a refund to the extent disclosed and permitted by law. Refunds are returned only through the original payment method; the payment provider controls posting time. Do not arrange off-platform refunds.
7. Host duties and safety standards
Every Host must:
- provide complete, accurate listings and promptly correct material changes;
- lawfully operate the experience and maintain all licenses, permits, permissions, registrations, and tax compliance;
- maintain insurance appropriate to the activity, location, personnel, vehicles, equipment, and reasonably foreseeable risks;
- use qualified personnel, reasonably maintained venues and equipment, clear meeting instructions, and an appropriate emergency plan;
- disclose material physical demands, accessibility limits, age restrictions, loud sound, alcohol, food allergens, transportation, weather dependencies, and unusual hazards before booking;
- deliver the experience substantially as described, treat Guests lawfully and respectfully, and report serious incidents promptly to emergency services and Music Experiences;
- keep material pre-booking communications, payment, cancellation, and refunds on the Platform; and
- comply with the Host Agreement & Safety Standards and Community Standards.
We may request supporting documentation, pause or remove a listing, cancel a booking, hold or adjust a payout where permitted, or suspend Platform access when reasonably necessary for safety, fraud prevention, legal compliance, investigation, or enforcement.
8. Guest duties and conduct
Guests must provide accurate participant information, review the listing and safety disclosures, arrive on time, follow lawful Host and venue instructions, use reasonable care, and disclose relevant accommodation needs early enough for the Host to evaluate them. Guests are responsible for deciding whether an experience is appropriate for their health, abilities, age, experience, and circumstances and should consult a qualified professional when needed.
Harassment, discrimination, credible threats, violence, deliberate property damage, dangerous intoxication, illegal drugs, weapons prohibited by law or venue rules, unauthorized recording, theft, exploitation, and materially disruptive or unsafe conduct are prohibited. A Host may refuse or end participation when reasonably necessary for safety or serious misconduct; refund eligibility then follows Section 6 and applicable law.
9. Participant agreement, assumption of risk, and release
Music and cultural activities may involve inherent and other risks, including loud sound and hearing injury, dancing, walking, standing, stairs, crowds, instruments, cables, stages, vehicles, alcohol, food, weather, unfamiliar venues, travel, illness, acts of other people, and limited access to medical care. The examples are not exhaustive.
Checkout acceptance does not replace the separate booking-linked Participant Agreement, Assumption of Risk, and Release. Each adult participant must sign for themselves; a parent or legal guardian must sign for a participating minor. Participation may be refused when a required waiver has not been completed. The exact waiver available for review before payment and signed for the booking is incorporated into these Terms.
10. Independent venues, transportation, and other suppliers
Experiences may use independent venues, ticketing services, transportation providers, restaurants, instructors, performers, rental companies, equipment providers, and other suppliers. Their own terms and safety rules may apply. Except when Musical Getaways LLC is expressly identified as the direct provider, those suppliers are not our employees or agents, and we are not responsible for their independent acts or omissions except to the extent liability cannot lawfully be excluded.
11. Insurance and personal property
Guests are responsible for medical, accident, personal property, and travel-related costs arising from participation. We strongly recommend insurance appropriate to the booking, including cancellation and interruption coverage when travel is involved. The Platform, Host, and venue are not custodians of personal property unless expressly agreed in writing.
12. User content, reviews, and optional media consent
You retain ownership of content you submit, but grant Musical Getaways LLC a non-exclusive, worldwide, royalty-free, sublicensable license to host, reproduce, adapt for formatting, display, and distribute it as reasonably necessary to operate, improve, document, and promote the Platform and applicable listing. You represent that you have the rights needed to grant that license.
Reviews must reflect genuine experience and may not be fraudulent, retaliatory, extortionate, defamatory, unlawful, privacy-invasive, or infringing. We may moderate or remove content and preserve it for disputes or legal compliance. Promotional photo/video permission requested in the participant flow is optional and separate from required booking and waiver acceptance.
13. Communications, privacy, and marketplace integrity
The Privacy Policy and Cookie Policy explain how information is handled. Users may not use contact information, links, payment instructions, or communications to bypass Platform booking, payment, fees, safeguards, or records. We may use proportionate automated and manual measures to detect fraud, unsafe content, prohibited off-platform steering, or violations of the Community Standards, subject to applicable law and our privacy disclosures.
14. Sanctions, export controls, and legal compliance
You may not use the Platform in violation of applicable laws, sanctions, anti-money-laundering rules, export controls, anti-bribery rules, consumer-protection law, or the rights of another person. Musical Getaways LLC may refuse, pause, or terminate a transaction that reasonably presents a legal, sanctions, fraud, or safety risk.
15. Disclaimers
To the fullest extent permitted by law, the Platform is provided “as is” and “as available.” We do not warrant uninterrupted access, error-free operation, particular results, or that every User, Host, listing, venue, or supplier will satisfy every expectation. Nothing in these Terms excludes warranties, remedies, or rights that cannot lawfully be excluded.
16. Limitation of liability
To the fullest extent permitted by law, Musical Getaways LLC and its owners, officers, employees, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, loss of opportunity, loss of enjoyment, lost profits, or loss of data arising from the Platform or a booking, even if advised of the possibility.
To the fullest extent permitted by law, our aggregate liability arising from a particular booking will not exceed the amount paid to Musical Getaways LLC through the Platform for that booking. These limitations do not apply to gross negligence, willful misconduct, fraud, non-waivable statutory or regulatory duties, strict products liability, or other liability that applicable law does not permit to be limited.
17. Indemnification
To the fullest extent permitted by law, each User agrees to defend, indemnify, and hold harmless Musical Getaways LLC, MusicExperiences.com, and their owners, officers, employees, and representatives from third-party claims, liabilities, damages, judgments, penalties, and reasonable costs arising from that User’s unlawful conduct, material breach of these Terms, infringement of another person’s rights, or, for a Host, operation of the Host’s experience. This obligation does not require indemnification for a protected party’s gross negligence or willful misconduct.
18. Payment disputes and chargebacks
Contact info@musicexperiences.com promptly and allow a reasonable opportunity to investigate a billing or service concern before initiating a chargeback, except where law or payment-network rules preserve an immediate right. A chargeback may be used for a genuinely unauthorized transaction or another legally valid basis; it may not be used to evade a disclosed cancellation policy or retain both a refund and the booked service. We may submit booking, acceptance, communication, attendance, refund, and electronic-signature records to payment providers and may recover amounts lawfully determined to be owed.
19. Force majeure
No party is liable for delay or failure caused by events beyond reasonable control, including severe weather, natural disaster, epidemic, government action, war, terrorism, civil unrest, labor disruption, utility or communications failure, venue closure, transportation disruption, or similar events. The affected party must use reasonable efforts to reduce avoidable harm. Refunds and credits remain governed by Section 6, supplier recoverability, applicable law, and any Guest-favorable listing terms.
20. Suspension and termination
We may restrict, suspend, or terminate an account, listing, booking, communication feature, or payout when reasonably necessary to address safety, fraud, nonpayment, chargeback exposure, legal compliance, sanctions, repeated complaints, material breach, or risk to Users or the Platform. Where circumstances reasonably permit, we will provide notice and an opportunity to respond. Termination does not erase accrued payment, refund, indemnity, confidentiality, dispute, or record obligations.
21. Governing law and disputes
Colorado law governs these Terms, without regard to conflict-of-law principles, except where mandatory consumer law applies. Before filing a claim, the parties will make a good-faith effort to resolve it through written notice and informal discussion. Unless applicable law requires another forum, exclusive jurisdiction and venue lie in the state courts located in Jefferson County, Colorado, or the federal court serving Jefferson County. To the fullest extent permitted by law, claims must be brought individually and not as a plaintiff or class member in a class, collective, consolidated, or representative action.
22. Electronic records and signatures
You consent to electronic contracting, disclosures, notices, records, and signatures. Checking a required box, typing a name where identified as a signature, or completing another clearly presented electronic-signature action is intended to authenticate the applicable record. You may retain copies by printing or saving the displayed page and confirmation. Contact us if you need an accessible format.
23. General provisions
These Terms and incorporated policies are the entire agreement concerning Platform use and marketplace bookings, except for a transaction-specific written agreement expressly stating that it controls. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remainder will continue. Failure to enforce a provision is not a waiver. Users may not assign these Terms without our written consent; Musical Getaways LLC may assign them in connection with a lawful reorganization, financing, sale, or transfer of the Platform.
We may update these Terms prospectively. Material changes will be identified by a new effective date and, when legally required, additional notice or renewed acceptance. The version accepted at booking governs that booking unless a later change is required by law or expressly agreed.
