Musical Getaways LLC d/b/a MusicExperiences.com

1. Introduction & Agreement

  • 1.1 Parties. These Terms and Conditions (the “Agreement”) govern the access to and use of the website, platform, and services operated by Musical Getaways LLC, a Colorado limited liability company, doing business as MusicExperiences.com (“MusicExperiences.com,” “Musical Getaways,” “we,” “us,” or “our”). By creating an account, browsing, listing, booking, paying for, or otherwise using our platform, you (“you,” “User,” “Guest,” “Host,” or collectively “Users”) agree to be legally bound by this Agreement.
  • 1.2 Marketplace Model. MusicExperiences.com is an online marketplace that connects individuals who provide cultural, musical, or educational experiences (“Hosts”) with individuals seeking to participate in such experiences (“Guests”). MusicExperiences.com does not own, operate, or control the experiences listed on the platform. Hosts are independent contractors and are solely responsible for their offerings.
  • 1.3 Entire Agreement. This Agreement, together with our Privacy Policy, Host Guidelines, Cancellation & Refund Policy, and any additional terms incorporated by reference, constitutes the entire agreement between you and MusicExperiences.com.

2. Eligibility & Accounts

  • 2.1 Eligibility. Users must be at least 18 years of age to create an account, host, or book an experience. Minors may participate only when accompanied by a responsible adult with the consent of the Host.
  • 2.2 Accounts. Users may create one account and switch between Guest and Host roles. You are responsible for safeguarding your account credentials. You may not impersonate another person, misrepresent your identity, or create multiple fraudulent accounts.
  • 2.3 Termination. We may suspend or terminate your account at any time for violation of these Terms, non-payment, fraud, abuse, harassment, illegal activity, or other conduct detrimental to the platform or its users.
  • 2.4 Account Deletion. You may delete your account through the account settings page. Deletion does not relieve you of obligations incurred before the date of termination (including pending bookings, payouts, or disputes).

3. Platform Role & Disclaimer

  • 3.1 Independent Hosts. Hosts are independent contractors, not employees, agents, or partners of MusicExperiences.com. We do not supervise or guarantee the safety, legality, quality, or suitability of any Host or Experience.
  • 3.2 No Guarantee. By using the platform, you acknowledge that experiences may involve risks, including travel, transportation, performance, or physical activity. MusicExperiences.com does not guarantee the accuracy of listings or the performance of Hosts. Guests participate at their own risk.
  • 3.3 Third-Party Services. Payment processing, identity verification, background checks, and communications may involve third-party service providers. We are not responsible for their acts or omissions.

4. Payments, Pricing & Fees

  • 4.1 Third-Party Payment Provider. All payments are processed through a third-party payment provider. By making or receiving payments, you agree to comply with that provider’s terms.
  • 4.2 Bookings. Guests pay the total listed price at the time of booking. Funds are held until the experience occurs.
  • 4.3 Pricing & Markup. Hosts set a base price for their experience. The platform applies a markup (currently 18%, subject to change by us) that is automatically included in the guest-facing price. Guests see only the final price; no additional service fee line items are displayed.
  • 4.4 Payouts. Hosts receive payouts net of platform markup. Payouts are made through the third-party payment provider, generally within 24–48 hours of experience completion. Hosts may select their payout currency from those supported by the provider. Payout timing and availability are subject to provider policies, currency restrictions, and applicable law.
  • 4.5 Non-Circumvention. Hosts and Guests agree not to circumvent the platform by arranging off-platform payments for experiences discovered through MusicExperiences.com.

5. Cancellations & Refunds

  • 5.1 Guest Cancellations. 7+ days before experience: Full refund. 2–6 days: 50% refund to Guest, 50% payout to Host. <48 hours: Non-refundable.
  • 5.2 Host Cancellations or No-Shows. Guests receive a full refund; Hosts receive no payout.
  • 5.3 Platform Discretion. In extraordinary circumstances (illness, natural disaster, government order, etc.), the Platform may override policies and issue refunds at its discretion.
  • 5.4 Refund Limitations. Refunds will be processed only through the original method of payment. Transaction fees or currency conversion costs are non-refundable.

6. Host Obligations

  • Provide accurate and complete listings.
  • Deliver the experience as described.
  • Maintain required licenses, permits, and insurance.
  • Comply with all applicable laws, including health, safety, and accessibility regulations.
  • Accept that listings and accounts require admin approval before publication.
  • Not discriminate against Guests on the basis of race, gender, religion, national origin, disability, or other protected status.

7. Guest Obligations

  • Review listing details before booking.
  • Arrive on time and comply with Host instructions.
  • Respect Hosts, fellow Guests, and local communities.
  • Not engage in unlawful, disruptive, or abusive conduct.

8. User Content & Reviews

  • Hosts and Guests may post reviews, photos, and other content.
  • By posting, you grant MusicExperiences.com a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute such content for promotional purposes.
  • You may not post defamatory, obscene, infringing, or unlawful content.
  • We reserve the right to remove content at our discretion.

9. Insurance & Assumption of Risk

  • Guests acknowledge that experiences may involve risks (travel, transport, music, performance, equipment, etc.).
  • Guests assume all such risks by booking and participating.
  • We strongly encourage Guests to carry travel insurance.
  • Hosts are solely responsible for any liability insurance needed for their activities.

10. Force Majeure

  • We are not liable for delay or failure due to events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, strikes, labor disputes, pandemics, government orders, or technical failures.

11. Sanctions, Export Controls & Compliance

  • Users agree not to use the platform for activities in violation of U.S. or international sanctions laws. Musical Getaways LLC reserves the right to refuse or terminate services that may expose it to sanctions liability (including OFAC restrictions).

12. Limitation of Liability & Indemnification

  • 12.1 Limitation. To the fullest extent permitted by law: Our liability is limited to the amount you paid for the booking giving rise to the claim. We are not liable for indirect, incidental, special, punitive, or consequential damages.
  • 12.2 Indemnification. You agree to indemnify and hold harmless MusicExperiences.com, its affiliates, directors, employees, and contractors against claims arising from your conduct, breach of these Terms, or participation in any experience.

13. Governing Law & Disputes

  • This Agreement is governed by the laws of the State of Colorado, USA.
  • Any dispute shall be resolved by mediation and binding arbitration in Denver, Colorado.
  • Class action waivers apply; claims must be brought individually.

14. Miscellaneous

  • Severability: If any provision is unenforceable, the remainder remains valid.
  • Waiver: Failure to enforce any right is not a waiver.
  • Assignment: Users may not assign rights under this Agreement; we may assign without restriction.
  • Entire Agreement: This Agreement, along with incorporated policies, constitutes the entire agreement between the parties.
