Participant Waiver

Participant Agreement, Assumption of Risk, and Release

This is a legally binding agreement. It affects substantial legal rights, including the right to sue. Read it carefully before signing.

Booking: The final signed copy will identify the specific experience, booking number, date, and time.

In consideration for being permitted to participate, I agree with Musical Getaways LLC, doing business under the trade name MusicExperiences.com (“Music Experiences”), as follows.

Released Parties

“Released Parties” means Musical Getaways LLC and MusicExperiences.com; their owners, officers, employees, representatives, volunteers, successors, and assigns; the applicable Host; participating venues; and the independent instructors, performers, transportation providers, equipment providers, contractors, and suppliers involved in the experience, together with each of their owners, officers, employees, agents, representatives, volunteers, successors, and assigns.

Marketplace and independent hosts

Music Experiences operates a marketplace connecting Guests with independent Hosts and third-party venues and suppliers. Unless a listing expressly states otherwise, the Host controls and provides the activity. Independent Hosts and suppliers are not employees or agents of Musical Getaways LLC, and Music Experiences does not control every act or omission of those parties.

Participant representations

I confirm that I am an adult participant signing for myself or the parent/legal guardian of the identified minor. I have reviewed the listing, material safety information, physical demands, accessibility information, and participation requirements. I will ask questions before participating, use reasonable care, follow lawful safety instructions, and not participate beyond my abilities or while dangerously impaired.

Risks and hazards

Music and cultural experiences may involve loud sound and possible hearing injury; dancing; walking or standing for extended periods; stairs; uneven, wet, dark, or crowded areas; instruments; cables; stages; lighting; electrical or sound equipment; vehicles and transportation; food, beverages, alcohol, and allergens; weather; unfamiliar venues or neighborhoods; travel; communicable or other illness; limited access to medical care; and the acts, omissions, or ordinary negligence of other participants, Hosts, venues, or suppliers. Conditions may change without warning. These examples are not exhaustive, and injury, illness, property loss, disability, or death may occur.

Knowing and voluntary assumption of risk

I knowingly and voluntarily accept all inherent and other risks of participation, whether known or unknown, anticipated or unanticipated, including risks arising from the ordinary negligence of a Released Party. I accept personal responsibility for deciding whether to participate, for my conduct, and for appropriate medical, accident, personal-property, and travel insurance and resulting costs.

Release and covenant not to sue

To the fullest extent permitted by law, I release, waive, discharge, and covenant not to sue any Released Party for claims, demands, damages, losses, liabilities, or causes of action arising from or related to booking, traveling to or from, attending, or participating in the experience, including claims based on a Released Party’s ordinary negligence. This release applies to me and to anyone claiming through me. It does not apply to gross negligence, willful misconduct, fraud, non-waivable statutory or regulatory duties, strict products liability, or other rights that cannot lawfully be waived.

Indemnification

To the fullest extent permitted by law, I agree to defend, indemnify, and hold the Released Parties harmless from third-party claims and reasonable costs arising from my unlawful or unsafe conduct, intentional misconduct, material violation of safety instructions, damage I cause, or material breach of this agreement. This obligation does not require indemnification for a Released Party’s gross negligence or willful misconduct.

Medical care and conduct

If I cannot provide consent during an emergency, I authorize reasonable first aid, emergency assistance, and transportation to medical care. I understand that the Released Parties do not promise that medical personnel or particular treatment will be available and that I am responsible for resulting costs. I may be refused or removed without a refund when my conduct creates a material safety risk or seriously interferes with others, subject to applicable law and the booking terms.

Minors

If signing for a minor, I confirm that I am the minor’s parent or legal guardian, have authority to sign, consent to the minor’s participation, have reviewed the activity on the minor’s behalf, and accept this agreement for the minor to the fullest extent permitted by law. I agree to indemnify and hold the Released Parties harmless from claims brought by or for the minor to the extent permitted by law, except for claims that cannot lawfully be released or indemnified.

Law, severability, and entire agreement

Colorado law governs this agreement, and the dispute and forum provisions in the Music Experiences Terms & Conditions are incorporated here. Unless mandatory law requires another forum, exclusive jurisdiction and venue lie in the state courts located in Jefferson County, Colorado, or the federal court serving Jefferson County. If any portion is unenforceable, it will be enforced to the maximum lawful extent and the remaining portions continue. This signed version is the entire participant waiver for this booking and may be changed only in a written agreement.

Electronic signature

By signing electronically, I confirm that I had the opportunity to read and ask questions, understand that I am giving up substantial legal rights, intend my typed name to authenticate this agreement with the same effect as a handwritten signature, and sign knowingly and voluntarily without coercion.
